REGULATIONS ON THE PROCESSING AND PROTECTION OF PERSONAL DATA OF "PRO ELECTRIC GROUP" LIMITED LIABILITY COMPANY

1. General concepts and scope of application

The company - Limited Liability Company "PRO ELECTRIC GROUP" (hereinafter referred to as "FASTER") respects the rights relating to personal data of personal data subjects, which it receives in the course of its activities, and strives to protect them.


This Regulation determines the methods of collection, processing, use and protection of personal data, which include (including but not limited to) data about:

  • visitors of websites and other online resources of FASTER (hereinafter - the "Site");

  • individuals and legal entities with whom FASTER cooperated in the framework of its activities (contractors, buyers and suppliers of goods and services);

  • any other third parties, in the framework of interaction, communication, cooperation with which FASTER has received or could gain access to the personal data of such third parties.


This Regulation is binding on the authorized person (as defined below) and employees/representatives of FASTER who directly process and/or have access to personal data in connection with the performance of their duties.


In this Regulation, the following terms are used in the following meaning:

  • personal data base - a named set of ordered personal data in electronic form and/or in the form of personal data files;

  • authorized person - a designated person among FASTER employees/representatives and/or partners who organizes the work related to the protection of personal data during their collection and processing;

  • owner of the personal data database - FASTER, which, with the consent of the personal data subject, is granted the right to process these data, which approves the purpose of processing personal data in this database, establishes the composition of these data and the procedures for their processing, unless otherwise provided by the Law (as this term is defined below);

  • personal data subject (hereinafter referred to as the "Subject") - any natural person whose personal data is processed by FASTER in accordance with its purposes and the purpose of processing defined in this Regulation;

  • publicly available sources of personal data - directories, address books, registers, lists, catalogs, databases, other systematized collections of open information containing personal data placed and published with the knowledge of the Subject (as this term is defined below);

  • Law - the Law of Ukraine "On Personal Data Protection" No. 2297-VI dated June 01, 2010 (as amended);

  • consent of the subject of personal data - voluntary expression of will of an individual (subject to his/her awareness) to grant permission to process his/her personal data in accordance with the formulated purpose of their processing, expressed in writing or in a form that allows to conclude that the consent has been given;

  • processing of personal data - any action or set of actions performed in whole or in part in the information (automated) system of personal data related to the collection, registration, accumulation, storage, adaptation, modification, updating, use and dissemination (distribution, sale, transfer), depersonalization, deletion of information about the Subjects;

  • personal data - data that personally identifies the Subject, both separately and in combination with other information available to FASTER, including from publicly available sources of personal data;

  • personal data controller - a natural or legal person who is authorized by the owner of personal data or by law to process this data on behalf of the owner 2. This document defines who is the data controller and data processor under this policy and how the Data Subject can contact FASTER;

  • ways to transfer FASTER personal data of the Subject to third parties;

  • the rights of the Subject regarding his personal data;

  • amendments to the Regulation.

3. Purpose of collecting and processing personal data

FASTER collects and processes personal data in order to:

  • registration, accumulation, storage and updating of information about the Subjects, as well as other third parties;

  • obtaining information about FASTER's activities by the Subjects;

  • interaction with the Subjects in order to sell goods (provide services) to FASTER;

  • obtaining assistance to protect the legitimate rights and interests of FASTER;

  • implementation of the goals and objectives provided for by the constituent documents of FASTER.

4. Owner of personal data

FASTER is the controller of the Subject's personal data within the meaning of Article 4 of the Law.

5. Information that FASTER may collect about the Subject

FASTER may collect and process personal data of the Subject:

  • in the course of activities, including through the Website;

  • during communication with FASTER by e-mail or other means of communication;

  • when the Subject registers for or inquires about FASTER events and activities;

  • when the Subject sends requests for information about FASTER goods (services), as well as when the Subject receives it;

  • as part of the Subject's responses to notifications or requests for information from FASTER.


Personal data that FASTER may collect and process includes (but is not limited to)

  • the name of the Subject, the name of the business entity, enterprise, institution or organization that the Subject represents, owns, founds, participates in, of which the Subject is a member, in which the Subject works or has worked, the position of the Subject;

  • postal address, e-mail address, contact phone numbers of the Subject, identifiers of other means of communication with the Subject;

  • information about visits to the Site, pages of FASTER or its partners in social networks;

  • information about materials and messages that FASTER sends to the Subject in electronic form;

  • information provided by the Subject for the purposes of: obtaining information about the terms of service, purchasing, consuming or using FASTER products, attending FASTER events and activities;

  • identification and reference information provided by the Subject or collected as part of FASTER's operational processes.

6. Obtaining the Subject's information

6.1. Personal data provided by the Subject to FASTER

FASTER collects and processes the Subject's personal information as part of FASTER's production processes, as well as for communication, marketing, promotion, sales, production, quality control, feedback on FASTER products and FASTER events and activities.

6.2. Information that FASTER may collect automatically

When you visit the FASTER Website, certain information is automatically collected that does not allow you to identify the Subject. This information may include the following.

6.2.1. Browsing statistics

FASTER collects information about the sections of the Site that are mainly viewed by visitors, the frequency of connections to the Site, the software and hardware used to visit the Site, the geography of visitors. This information allows FASTER to understand how visitors work with the Website.

6.2.2. Logs

FASTER's hosting provider's equipment may record requests made by visitors to the Site, information about the software and hardware used to visit the Site, the assignment of the IP address, and the time associated with access. FASTER uses this information to improve the security of the Website.

6.2.3. Cookie file

A cookie is a text string that the Site transfers to a browser cookie on the Subject's computer so that the Site can remember the Subject's settings. FASTER uses cookie data to analyze visitor behavior and improve the user experience. The Subject may disable cookies through the browser settings. FASTER places a warning on the website, in the form of Annex 1 to this provision.

6.3. Information that FASTER collects from other sources

FASTER may receive information about the Subject from other sources (including publicly available sources of personal data), as well as from third parties who help

  • update, expand and analyze FASTER records;

  • identify persons interested in FASTER goods (services);

  • prevent or detect fraud.

FASTER may also receive information about the Subject from social media platforms, including but not limited to when the Subject interacts with FASTER on these platforms or accesses FASTER's social media content. The information that FASTER may receive is governed by the privacy settings and procedures of the relevant social network, which FASTER advises you to read.

7. Use of the Subject's information

FASTER collects and processes the Subject's personal data in various ways, including, but not limited to, through the use of the Website. FASTER uses such information to:

  • answering the Subject's questions about the goods (services) sold by FASTER, about its activities;

  • improvement of the Website.

8. Storage of personal data

FASTER will store the collected personal data as long as it is necessary to fulfill the purpose of processing specified in this Regulation.

To determine the appropriate retention period, FASTER will consider the volume and nature of the collected data, including the special categories of personal data defined in part 1 of Article 7 of the Law, the potential risk of harm from unauthorized use or disclosure and the purposes for which FASTER processes personal data.

After the expiration of the storage period, the collected personal data will be destroyed taking into account the security rules.

9. Transfer of personal data to third parties

FASTER may transfer the Subject's personal data to certain third parties, including:

  • FASTER's IT providers, including cloud service management providers;

  • third parties involved in the sale of goods (provision of services) FASTER.

If necessary or for the reasons set out in this Regulation, personal data may also be provided to state and local authorities, courts, government agencies and law enforcement agencies.

FASTER does not sell, rent or otherwise provide personal data of the Subjects for commercial purposes.

10. Data Subject's Rights

The Subject has the right to:

  • request access to their personal data and learn about their processing;

  • request correction of the Subject's personal data;

  • request the destruction of the Subject's personal data;

  • to request restriction of processing of the Subject's personal data;

  • object to the processing of the Subject's personal data;

  • withdraw consent (if any) to the processing of the Subject's personal data;

  • file a complaint regarding the processing of the Subject's personal data by FASTER.


The Subject may exercise his/her other rights in accordance with the legislation on personal data protection.

If personal data is deleted at the request of the Subject, FASTER will retain only such copies of the information as are necessary to protect the legitimate interests of FASTER or third parties, resolve disputes or perform any transaction in the performance of any agreement that the Subject has entered into with FASTER.

11. Processing of information about minors

The Site is not directed to and is not intended for persons under the age of 18.

If the Subject is under 18 years old, he/she must not provide FASTER with personal data without the consent of parents, guardian, guardianship and custody authorities.

In case FASTER discovers personal data of the Subjects under the age of 18, such personal data will be promptly deleted.

12. Links

The Website may contain links to third-party websites. FASTER is not responsible for the protection of personal data, content and privacy practices of such third-party websites.

13. Authorized person of FASTER

The authorized person organizes work related to the protection of personal data during their processing in accordance with the law.

The authorized person is determined by the Head of FASTER.

The authorized person is obliged to

  • know the legislation in the field of personal data protection;

  • ensure that representatives/employees and/or partners of FASTER comply with the requirements of the legislation in the field of personal data protection, theGeneral Data Protection Regulation (GDPR; Regulation (EU) 2016/679)Regulation (EU) 2016/679), this Regulation and other documents in the field of personal data that FASTER may adopt from time to time

  • to notify the FASTER management of the facts of violations by employees and/or partners of the requirements of the legislation of Ukraine in the field of personal data protection, this Regulation and other documents in the field of personal data, which FASTER may adopt from time to time no later than 1 (one) working day from the date of detection of such violations.

In order to perform his/her duties, the authorized person has the right to

  • make copies of the received documents, including copies of files, any records stored in local computer networks and autonomous computer systems;

  • access to all premises, documents, telecommunication facilities of FASTER;

  • participate in the discussion of issues related to the protection of personal data;

  • interact with other representatives / employees and/or partners of FASTER in the performance of their duties in organizing work related to the protection of personal data during their processing.

Representatives / employees and / or partners who have access to personal data and process them are obliged to prevent the disclosure in any way of personal data entrusted to them or which became known in connection with the performance of professional or official or employment duties.

Persons who have access to personal data, including those who process them, in case of violation of the requirements of the legislation on personal data protection shall be liable as provided by the current legislation.

14. Amendments to this Regulation

The Regulation is approved by the General Meeting of FASTER participants.

FASTER reserves the right to make changes and amendments to this Regulation.

FASTER recommends that the Subjects periodically review the page of the Website, which contains information on the processing and protection of personal data.

In case of any significant changes to this Regulation, FASTER will notify the Subject by publishing a notice of changes on the Website.
